I apologize on behalf of the Bank for our late response, We had to make several consultations before the below response.
The management board has directed me after the meeting concluded today 16th Febraury 2005, to inform you as follows:
(1) Barrister Michael Azu has been verified with the Nigerian bar association in our letter to them reference number CSL/VDI/438659/SBZ-04. Barrister Michael Azu has been confirmed to us as a qualified attorney, called to bar in octobar 8th 1989. His certificate of call to bar number is NBA/EBC4706/SAT. Based on this report, he is a legitimate and qualified attorney.
Under the Nigerian laws which now supersedes the terms of the deposit agreement, a distant relation of the deceased, with an authentic proof of relationship with the deceased person, as well as an attestation to your identity can come for the claim of the deposit, being the fact that persons mention in the deposit agreement as the next of kin of the deceased are equally dead.
In accordance with section 208C to E sub-sections 12 to 21 of Lagos state inheritance laws of 1988, which should be applied in the circumstances of the death of Mr Mark Rappa, we are allowed to oblige your request for the claim of the deposit under the conditions of BENEFIT OF DOUBTS.
The Management board of our Bank has reached the agreement to give you this benefit since no other person has come for this deposit since the death of Mr. Mark Rappa
Furthermore, you have been approved of your late Brother fund US$12.8M (Twelve million, Eight Hundred Thousand U.S. Dollars only Please accept our heart felt condolence to your family on behalf of the entire management and staff of Diamond Bank Ltd.
